Michael Jackson's "This Is It" single release & the estate suing the HTWF

Today I read that Sony Music is releasing "This Is It" online at midnight Sunday night on Michael Jackson.com. Its the first single from the limited edition two-disc set which contains music from both the documentary coming out for a limited release October 27, 2009 along with some of his biggest hits. The other items coming out this month are The Official Michael Jackson Opus, which will be the "Only Brand New Authorized Tribute To The King Of Pop On Holiday Shelves", along with the re-release of the 1988 autobiography Moonwalk.
A few weeks ago I read Michael Jackson's estate was suing the Heal The World Foundation because they
 claim he was not affiliated with it at all and they are misleading people and using trademarks of the estate and have applied for many more. I immediately went to the site to see what they had to say.
Their About Us page they very clearly state that he was not affiliated with it and they are preserving his vision. They detail the history of the foundation completely. It was founded by Michael Jackson in 1992 but lost it's tax exempt status from 2002 to 2008. The foundation states the false accusation, trial and the attacks which destroyed much of his credibility. He was focusing all of his time, energy and most of his money on protecting his family and defending himself. The foundation did continue as much as it could and in 2008 did regain it's charity status. He is listed as President Emeritus for the foundation now.

The information was written when the foundation created the site I think, but none the less it was definitely written before his death. Because they state that he is the President Emeritus and though he had to take a step out of the charity for a while, he will lead the foundation again. They have posted a short press release defending the foundation and they have offered any members the ability cancel their membership or donations immediately.
I wanted to know what people thought about these two things the estate are doing. I have some thoughts but I wanted to hear others also see if there is anything I have stated incorrectly or have missed first.
